PUBLIC OFFER AGREEMENT
Sale of electronic tickets for cultural and entertainment events
- DEFINITIONS
In this document, the terms below are used equally in the singular and plural (unless otherwise follows from the meaning of the term and/or definition) in the following meanings:
1.1. Agent
Artlive.one — an online platform for the sale of electronic tickets for cultural and entertainment events, operating on the basis of agreements concluded with Event Organizers and/or Principals.
1.2. Cancellation
Removal of Electronic Tickets from an Order with their automatic return to open sale in the System. An Order that is not paid within the Reservation Period is cancelled automatically after its expiration (unless otherwise provided by additional information on the website).
1.3. Electronic Ticket
A document generated using the Agent’s automated System on an electronic or paper medium, confirming the Buyer’s right to attend the Event and containing a barcode (QR code), order number, name of the Service Recipient, information about the name, date and venue of the Event, seat (sector, row, etc.), service price, and the amount of the Service Fee.
1.4. Reservation
A formed Order that is in the payment pending status.
1.5. Reservation Period
The period of time from the moment an Order is placed until the moment of its payment, set by the Agent separately for each Event.
1.6. Order
One or more Electronic Tickets for one Event selected by the Buyer and combined under a single identification number in the System.
1.7. Event
A cultural or entertainment event, including a concert, performance, show, festival, exhibition, sports competition, film screening, or other event, attendance of which is possible only with an Electronic Ticket.
1.8. Event Organizer
A legal entity or an individual entrepreneur who organizes and conducts the Event.
1.9. Offer
This Public Offer Agreement for the sale of electronic tickets, published on the website https://artlive.one.
1.10. Buyer
An individual or legal entity that uses the Agent’s services under the terms of this Offer.
1.11. Principal
A person who authorizes the Agent to sell Electronic Tickets for an Event.
1.12. Service Fee
An additional fee for booking and ticket issuance services charged by the Agent. The amount of the service fee is determined by the Agent and is indicated during the Order placement.
1.13. System
The automated information system Artlive.one intended for booking, issuing, and selling Electronic Tickets.
1.14. Acceptance
The Buyer’s full and unconditional acceptance of the terms of this Offer.
- GENERAL PROVISIONS
2.1. This Offer regulates the procedure and conditions for the sale of Electronic Tickets, as well as the rights and obligations of the Agent and the Buyer.
2.2. The sale of Electronic Tickets is carried out exclusively subject to the Buyer’s full acceptance of this Offer.
2.3. In case of disagreement with any provision of this Offer, the Buyer must refrain from purchasing tickets.
2.4. The Agent has the right to make changes to this Offer. The current version is always available on the website https://artlive.one.
2.5. Use of the website after changes are made signifies the Buyer’s agreement with the updated terms.
2.6. The Offer comes into force from the moment of its publication and is valid indefinitely.
- SUBJECT OF THE OFFER
3.1. The subject of the Offer is the provision to the Buyer of services for booking, issuing, and selling Electronic Tickets.
3.2. The Agent is not responsible for the organization, postponement, or cancellation of the Event.
3.3. The Buyer agrees to the processing of their personal data in accordance with the legislation of Ukraine for the purpose of fulfilling this Offer.
- ACCEPTANCE PROCEDURE
4.1. Acceptance of the Offer is carried out by placing and paying for an Order on the Artlive.one website.
4.2. Acceptance has the legal force of an agreement concluded in written form.
4.3. After payment, the Buyer receives the Electronic Ticket to the specified email address.
- PAYMENT PROCEDURE
5.1. Payment is made by non-cash methods available on the website.
5.2. The payment is considered completed from the moment of confirmation by the payment system.
5.3. In case of non-payment within the Reservation Period, the Order is cancelled.
- REFUNDS
6.1. Refunds are possible only in the event of cancellation of the Event in accordance with the conditions determined by the Organizer.
6.2. The Service Fee is non-refundable.
6.3. The Agent is not responsible for refunds carried out directly by the Organizer.
- PROMOTIONS AND CERTIFICATES
7.1. The Buyer may use promo codes and certificates in accordance with the terms of the promotions.
7.2. Promo codes are single-use and have a limited validity period.
- RIGHTS AND OBLIGATIONS OF THE PARTIES
The rights and obligations of the parties are determined by the current legislation of Ukraine and this Offer.
- LIABILITY
9.1. The parties bear responsibility in accordance with the legislation of Ukraine.
9.2. The Agent is not responsible for the actions of Event Organizers.
- ELECTRONIC TICKETS
10.1. The Buyer must keep the Electronic Ticket and must not transfer it to third parties.
10.2. In case of ticket duplication, access to the Event is granted upon the first presentation.
- TERM AND DISPUTE RESOLUTION
11.1. The Offer is valid indefinitely.
11.2. All disputes are resolved through negotiations, and if no agreement is reached — in accordance with the legislation of Ukraine.
